William West, Sr., brought suit in the state court under the Florida wrongful death statute, to recover damages for the death of his fourteen year old son, Nathaniel, who died instantly as the result of a collision on a public highway between the horse which the decedent was riding and the defendants bus. Plaintiff also sought damages for the value of the horse. Thereafter, and following the removal of the cause to the District Court for the Southern District of Florida, a trial by jury was had and at the conclusion of all of the evidence the court granted defendants motion for a directed verdict on the grounds that the evidence conclusively showed that the decedents negligence was the sole proximate cause of the accident and that there was no negligence on the part of the defendant or its driver. From the judgment entered on the directed verdict and the order denying his motion for a new trial, plaintiff has appealed.
