Plaintiff-Appellant Paul West ("West") is incarcerated in the Condemned Unit at the Menard Correctional Center in Illinois. On August 31, 1988, West filed a civil rights complaint pursuant to 28 U.S.C. § 1983, alleging that he is being subjected to cruel and unusual punishment in violation of the Eighth Amendment. Wests specific allegations stem from the alleged denial of proper medical treatment. West claims that the prison provided him with a "dirty filthy mattress" (Appellants Brief at p.3) and that as a result of having to sleep on the mattress his scalp became infected and his hair began to fall out. West believes that his death row status has caused prison officials to ignore his medical condition; he believes that if he received proper medical treatment his hair loss could have been avoided.
